The “click” you perform after completing your order form constitutes validation of your order and represents your irrevocable acceptance of these Terms and Conditions of Sale.
Consequently, you may only order products or services if you fully accept the conditions set out below.
Preamble
The following Terms and Conditions of Sale govern all transactions carried out through the Eloomm online catalog.
Any order placed on this website implies the customer’s unconditional and irrevocable acceptance of these Terms and Conditions.
Purpose
This contract is a distance sales contract and aims to define the rights and obligations of the parties in the context of the sale of products by Kechinfinitely via the Internet, through its e-commerce platform.
www.eloomm.ma is a service and a registered trademark of Kechinfinitely S.A.
Definitions
Distance contract:
Any contract concerning goods or services concluded between Kechinfinitely and a Consumer within the framework of a distance sales or service system organized by Kechinfinitely, using exclusively the Internet up to and including the conclusion of the contract.
Consumer:
Any natural person who, under this contract, acts for purposes that do not fall within the scope of their professional activity.
Order form:
A document indicating the characteristics of the products ordered by the Consumer, which must be validated by a “double click” to confirm commitment.
Order:
An act by which the Consumer commits to purchasing products and Kechinfinitely commits to delivering them.
Products
All products listed in the catalog are offered for sale subject to availability.
Kechinfinitely reserves the right to remove any product from the catalog at any time without prior notice.
Kechinfinitely cannot be held liable for compensation or order cancellation due to the buyer’s inability to use a purchased product because of incompatibility with existing equipment.
Placing an Order
After selecting the desired product(s), click on the “Order” button. The product will be added to your order form.
You may modify your order at any time or return to the catalog by clicking “Continue shopping.”
Once your selection is complete, validate your order by clicking the “Pay” button.
In case of an error when entering information on the order form, we recommend sending a cancellation request by email within 24 hours.
Once the order has been canceled by Eloomm, you may place a new order.
Prices
Prices displayed in the catalog are indicated in Moroccan dirhams (MAD), excluding taxes, and are valid at the time of consultation and order placement.
VAT is calculated on the order form according to the applicable rate on the day of the order.
All transactions are conducted in Moroccan dirhams. Any change in VAT rate will automatically be reflected in product prices.
Order Execution
Orders will be processed no later than 7 days from the day following the order date.
In the event of product unavailability, the Consumer will be informed as soon as possible and may cancel the order.
The Consumer may then choose either:
a refund of the amounts paid within a maximum of 30 days, or
an exchange of the product.
Delivery
Delivery is handled by Eloomm.
The customer will receive their order at the delivery address provided on the order form.
Prices include all taxes and are calculated based on the weight of the products.
Delivery fees are free, provided that the minimum order amount is 300 MAD.
A minimum preparation time of 45 minutes is required after payment confirmation, subject to product availability.
Payment Methods
To pay for your order, you may choose from the payment methods offered by Eloomm on the payment page.
Payments are secured through the Interbank Electronic Banking Center (CMI), which provides a fully secure payment service.
Data Confidentiality
The information requested is necessary for processing your order and is treated confidentially.
You have the right to request correction of your personal data.
You may receive promotional communications from Eloomm unless you explicitly refuse the use of your personal data for this purpose.
Right of Withdrawal
From the date of delivery, you have 7 days to exercise your right of withdrawal and receive a full refund.
Return shipping costs remain the responsibility of the customer.
Only products returned in perfect resale condition, complete and in their original unopened packaging, will be eligible for a refund.
Warranty
All products sold through the catalog are covered by a warranty against manufacturing defects and material faults for a minimum period of one year from the invoice date.
If returned products are found to be non-defective, transportation and handling costs may be charged to the customer.
The warranty does not cover damage resulting from accidents, misuse, or negligence.
Proof of Card Transactions
Data recorded by the CMI on the payment platform on behalf of Eloomm constitutes proof of all commercial transactions carried out between the customer and Kechinfinitely.
Force Majeure
Eloomm shall only be bound to fulfill its obligations insofar as no event of force majeure prevents or delays performance.
